Welcome to Famnest, a family coordination platform operated by Stair Path AB (org.nr: 559393-4887), a company incorporated under the laws of Sweden with its registered office at Trappstigen 21, 13337 Saltsjöbaden.

These Terms & Conditions (“Terms”) govern your access and use of Famnest, including our mobile application, web platform, and related services (collectively, the “Platform”). By accessing or using Famnest, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Overview

Famnest is a secure family coordination tool that allows users to manage sensitive data such as:

  • Medical information for children and family members
  • Custody schedules
  • Allergy and dietary needs
  • Communication with co-parents or guardians
  • Shared calendars, notes, and personal records

Famnest is designed for responsible use by parents, guardians, and approved contributors. The Platform is not intended for use as a legal or medical authority.

3. GDPR and Data Protection

Famnest is fully compliant with the General Data Protection Regulation (GDPR) (EU) 2016/679. The protection of your personal and sensitive data is our top priority.

Key Commitments:

  • All data is hosted on secure servers located within the EU.
  • We do not sell, rent, or trade any personal data.
  • Data is processed only for the purpose of delivering our services.
  • You have full control over your personal data and can manage, download, or request its deletion at any time.

Special Category Data:

Famnest allows you to input health and child-related data. By using the Platform, you confirm you have legal authority (e.g., as a parent or guardian) to share such data.

We will never process sensitive data (e.g., health or child-related information) without your explicit consent.

4. Account Registration and Access

You must be at least 18 years old or the legal guardian of a child user to create an account on Famnest. You are responsible for maintaining the confidentiality of your login credentials and ensuring no unauthorised access occurs.

You agree to:

  • Provide accurate and up-to-date information
  • Keep your account secure
  • Notify us immediately of any suspected security breach

5. License and Use Restrictions

You are granted a limited, non-transferable, revocable license to use Famnest. You may not:

  • Reverse engineer or resell the Platform
  • Upload malicious content or unauthorized third-party data
  • Use the Platform for any unlawful or exploitative purposes
  • Share other people’s sensitive information without consent

6. Shared Data and Access Permissions

Famnest enables collaboration between family members, caregivers, and professionals. Shared Data includes:

  • Messages
  • Medical records
  • Calendar events
  • Contact information
  • Documents and notes

Only users explicitly granted access to Shared Data can view it. You may revoke or manage access rights at any time via account settings.

7. Children's Data and Parental Consent

Famnest is built with the privacy and security of children in mind.

  • Parents/legal guardians must provide verified consent to store or process a child's personal or medical information.
  • Famnest will never knowingly collect data from children without guardian involvement.
  • You can review or delete your child’s data at any time through your account.

8. Subscription and Payments

Famnest may offer free or paid features. If you subscribe:

  • You agree to pay the applicable fees for your selected plan
  • Subscriptions auto-renew unless cancelled before the end of the billing period
  • You may cancel via your account or by contacting hello@getfamnest.com
  • Refunds are granted in accordance with EU consumer rights (14-day withdrawal period)

9. Third-Party Services

Famnest may integrate with trusted third-party services (e.g., cloud infrastructure) solely for platform functionality. All partners are required to meet GDPR standards and enter into Data Processing Agreements (DPAs) with us. We do not allow third parties to train AI models or commercialize your data.

10. Confidentiality and Security

Famnest applies industry-standard encryption and secure development practices. Your data is protected via:

  • End-to-end encryption during transmission
  • Secure EU data centres with access control
  • Internal policies on least-privilege access

In the event of a breach, you will be notified in compliance with GDPR.

11. Your Rights

Under GDPR, you have the right to:

  • Access your data
  • Rectify inaccurate data
  • Erase your data (“right to be forgotten”)
  • Restrict or object to processing
  • Data portability
  • Withdraw consent

12. Termination and Suspension

13. Legal Obligations and Disclosure

We may disclose user information if:

  • Required by EU law, court order, or lawful request from authorities
  • Necessary to enforce these Terms or investigate suspected misuse

You will be notified unless prohibited by law.

14. Limitation of Liability

Famnest is provided "as-is". To the maximum extent permitted by law, Stair Path AB is not liable for:

  • Loss of data due to user error
  • Indirect or consequential damages
  • Any damages exceeding the amount you paid in the last 12 months

15. Modifications to Terms

We may update these Terms to reflect changes in legal, technical, or business developments. You will be notified of material changes and your continued use indicates acceptance.

16. Governing Law

These Terms are governed by the laws of Sweden. Any disputes shall be resolved in the courts of Stockholm, unless otherwise required by applicable EU consumer protection laws.
